What do the new regulations require?

As of 1 June 2020, Landlords of privately rented accommodation must ensure the electrical installations in their rented properties are inspected and tested by a qualified and competent person at the start of a new tenancy and then at an interval of at least every 5 years.

They must obtain a report from the person conducting the inspection, which gives the results and sets a date for the next inspection and test and supply this report to any new tenant before they occupy the premises.

Where the report shows that remedial or further investigative work is necessary, this work must be completed within 28 days and written confirmation must be supplied to the tenant within 28 days of completion of the works.

Failure to comply with these regulations could result in a fine from the local authority of up to £30,000.

Electrical Installation Condition Reports (EICR) for Landlords

An Electrical Installation Condition Report (EICR) is a report carried out to assess the safety of the existing electrical installation within a property and is used to describe its condition. Parts of the system that are reported on include consumer units, protective bonding, lighting, switches and sockets etc. Its purpose is to confirm as far as possible whether or not the electrical installation is in a safe condition for continued service.

The EICR will show whether the electrical installation is in a ‘satisfactory’ or ‘unsatisfactory’ condition and will detail a list of observations affecting the safety or requiring improvements. Any remedial works listed as necessary will need to be undertaken within 28 days of the report.

PAT Testing for Landlords (Portable Appliance Testing)

It is recommended that landlords regularly carry out portable appliance testing (PAT) on any electrical appliance that they provide and then supply tenants with a record of any electrical inspections carried out as good practice.

Electrical Installation Condition Reports (EICR) & PAT Testing for Employers

In a commercial setting, an employer has a duty of care to protect their employees by ensuring that their work premises are safe. Electricity at Work Regulations require that electrical installations should be adequately maintained in order to prevent danger. An EICR provides evidence that these safety checks have been carried out and highlights the need for any remedial works.

Additionally any electrical equipment installed in the workplace should be PAT tested to ensure it is safe and suitable for the intended use. Damage/faults can occur with use, so it is essential items are tested regularly for safety.

Electrical Installation Condition Reports (EICR) for Homeowners

Unlike landlords, homeowners aren’t required by law to conduct a periodic electrical test, although it is often required as part of the buying or selling process but it is sensible to regularly check the safety of your home’s electrics by getting an electrician to undertake an Electrical installation condition report (EICR) – giving you reassurance that your home electrics are safe and free from dangerous faults.
